Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Glean (Chinese name "拾忆", "the App"), developed and published by Xinyan Studio ("we", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

These Terms supplement, but do not replace, the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement, which also apply to your use of the App. In the event of a conflict between these Terms and Apple's terms, Apple's terms govern with respect to billing, refunds, and other matters within Apple's exclusive control; these Terms govern with respect to the App's behavior and your rights regarding your data.

2. License to Use Glean

Subject to your compliance with these Terms, Xinyan Studio grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, in accordance with the usage rules established by the Apple App Store Terms of Service.

This license permits personal, non-commercial use. Limited use within a single business or organization is permitted; bulk distribution or resale is not.

You may not, and may not permit any third party to: (a) copy, modify, or create derivative works based on the App; (b) reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except where such activity is expressly permitted by applicable law notwithstanding this limitation; (c) remove, alter, or obscure any proprietary notices; or (d) use the App in any manner that violates these Terms or applicable law.

3. Your Content

All content you save in Glean — including text, links, images, files, code snippets, and any other clipboard items — remains yours. Xinyan Studio does not claim, acquire, or assert any rights of any kind over your content.

As described in our Privacy Policy, your content is stored only on your device and in your private iCloud container. We have no technical ability to access, read, or transmit your content, and we do not seek any such ability.

4. Acceptable Use

You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. You are solely responsible for the content you copy, store, and use within the App. You agree not to use Glean to:

• Engage in any activity that violates the laws or regulations of the People's Republic of China or any other jurisdiction applicable to you;
• Infringe upon the intellectual property rights, privacy rights, or other lawful rights and interests of any third party;
• Distribute malware, illegal content, or content that incites violence, hatred, or discrimination;
• Circumvent any technical measures intended to protect the App or its users.

5. Trial, Subscription, and Purchase

5.1 Free Trial

Upon first installation, you receive a 14-day free trial beginning on first launch, during which all features of the App are available without payment and without requiring a payment method.

5.2 Subscription and Purchase Options

To continue using paid features after the trial, you may choose one of three options:

• Monthly subscription: an auto-renewing subscription with a one-month term;
• Annual subscription: an auto-renewing subscription with a one-year term;
• One-time purchase (lifetime version): a single payment granting permanent use of Glean, including all future updates to the App.

The three options unlock the same features. They differ only in billing method and duration; there is no difference in the functionality provided under different options.

Current prices are displayed in the App at the time of purchase and reflect prices set by us in Apple App Store Connect. The specific amount may vary according to the App Store's local pricing tiers in different regions.

5.3 What Happens When the Trial Ends Without Subscription or Purchase

If you do not subscribe or purchase by the end of the trial, the App enters a limited-functionality state. Your data is never deleted; it remains on your device and in your private iCloud container.

In the limited state, the following functions remain available:

• Opening the App and browsing the most recent 50 items in your history;
• Continuing to automatically save new clipboard content;
• Synchronizing your data across your devices via iCloud;
• Searching your entire history.

The following functions are restricted until you subscribe or purchase:

• Copying any history item back to the system clipboard;
• Pasting any history item into another application, including through the iOS keyboard extension and Glean Stack on Mac;
• Editing, renaming, or deleting items;
• Creating, editing, deleting, or organizing favorite folders, and any operations involving favorites;
• Translation paste, plain-text paste, and other advanced paste modes;
• Browsing items beyond the 50th item in the history list, although search continues to work across all items.

Upon subscription or purchase, the restricted functions become immediately available, and all previously saved data — including data accumulated during the limited state — becomes fully usable.

5.4 Billing Through Apple

All payments are processed by Apple through the In-App Purchase system. Billing, renewal, charging, and receipts are subject to the Apple Media Services Terms and Conditions. Xinyan Studio does not directly receive your payment information.

5.5 Auto-Renewal

Subscriptions automatically renew unless you cancel them. Apple will charge the account associated with your Apple ID within 24 hours before the end of the current subscription period at the then-current price, subject to Apple's notice rules for price changes.

You may manage or cancel your subscription at any time:

• iOS / iPadOS: Settings → [your name] → Subscriptions → Glean;
• macOS: App Store → [your avatar] → [account name] → Subscriptions → Glean.

Cancellation takes effect at the end of the current billing period. Until then, the App continues to function with full features; after that, it returns to the limited state described in Section 5.3.

5.6 Refunds

Refunds are handled by Apple, not by us. To request a refund, please visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.

5.7 Price Changes

We reserve the right to change subscription prices. The effect of any price change on existing subscribers is governed by Apple App Store Connect policies; subscription price increases typically require explicit user consent before they take effect.

6. Intellectual Property

The App, including its source code, design, user interface, branding, logos, icons, and all related materials, is owned by Xinyan Studio and protected by the copyright, trademark, and other intellectual property laws of the People's Republic of China and other jurisdictions. The license granted in Section 2 does not transfer any ownership of the App to you.

"Glean" and "拾忆" are trademarks of Xinyan Studio.

7. Updates and Changes

We may release updates to the App from time to time, including bug fixes, security patches, new features, and removal or modification of existing features. Some updates may be required to maintain compatibility with new operating system versions or Apple platform requirements.

We may also revise these Terms. The version number and effective date at the top of this page always reflect the current version. For material changes, we will provide reasonable notice through an in-app notification on your next launch. Your continued use of the App after the effective date of the revised Terms constitutes acceptance of the changes.

8. Discontinuation of the App

We may decide to discontinue development of the App or remove it from the App Store. Even if we do so, any installed copy of the App may continue to be used as long as it remains compatible with your operating system, and your data stored locally on your device or synchronized through iCloud will not be affected by our discontinuation of the App. We have no technical ability to remotely disable the App or delete your data.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, XINYAN STUDIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. We do not warrant that iCloud synchronization will succeed in all circumstances; iCloud is operated by Apple and subject to its own service availability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XINYAN STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any event, our total aggregate liability for any claim arising out of these Terms or your use of the App shall not exceed the amount you have paid to us through Apple in the twelve (12) months preceding the event giving rise to the claim; for users who have not made any purchase, this limit shall be RMB 100 or USD $10 equivalent, whichever is higher.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict of law rules.

For users in mainland China, any dispute arising out of or relating to these Terms shall be submitted to the People's Court of Putian, Fujian Province, which shall have exclusive jurisdiction.

For users in other jurisdictions, the choice of law and forum above is supplemented by the dispute resolution provisions of the Apple Media Services Terms and Conditions; where any conflict arises and applicable law mandates a more user-favorable forum or remedy, the more favorable provision prevails.

12. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary to preserve its validity, while the remaining provisions of these Terms shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, including the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement where applicable, constitute the entire agreement between you and Xinyan Studio regarding the App and supersede any prior agreements or understandings concerning the same subject matter.
